CEAC’s 10th Anniversary Arbitration Conference on China’s Belt and Road Initiative


On September 13./14. 2018 the Chinese European Arbitration Center (CEAC) celebrated its 10th anniversary by hosting a high profile conference on China’s Belt and Road Initiative in Hamburg.

Topics were the resulting opportunities and challenges for international dispute resolution as well as contract drafting. More than 130 speakers and participants from all around the world shared their views, and developed new ideas.

CEAC is the only arbitration institution with a clear multilateral European-Chinese-Asean profile and a pioneer concerning legal questions around the Belt and Road Initiative. As China’s Belt and Road Initiative relates to both common and civil law jurisdictions, a main focus of the conference was the extent to which the UNIDROIT Principles and the CISG can build bridges between these two legal systems. This topic was particularly fitting for a CEAC conference because of the unique model choice of law clause in Article 35 CEAC Arbitration Rules that proactively promulgated the use of the UNIDROIT Principles. The diversity and composition of the panels resulted in most informative debates on the use of the UNIDROIT Principles of International Commercial Contracts (UNIDROIT Principles) and the United Nations Convention on Contracts for the International Sale of Goods (CISG). In conclusion, all panelists shared the view that the UNIDROIT Principles could be a useful tool in filling gaps existing in international contract law sources like the CISG.
